Our Constitution

In every country, there is a written law of a nation, which is called as a constitution. It is the fundamental part of the country, which makes and implements the law in the nation. A country runs its administrative works on the basis of constitutional law. The constitution is the written legal document, which has a law of the nation. Citizens and government operate under the law of a nation. So, the constitution is the main part of the country. The political parties and government, who govern the nation, determine the constitution of a country. Thus, it is called as "Mirror of the country". It is essential for the preservation of people’s rights and justice, to fulfill the wish of the people and to direct the nation to a specific goal. It helps people to give better and easy facility for the comfort life. It also works for the development of a nation.

The present constitution of our country is made in Asoj 3, 2072 B.S, which is the seventh constitution of Nepal. It is made by eight political parties Nepal has given some of the provision of rights to its citizens, which is fundamental right alright. Some fundamental rights are as follow:

  • Right to Freedom
  • Right to Equality
  • Right to Children
  • Right to Women
  • Right to Property
  • Right to Justice etc.

Nepal is a federal state, which means there will be no unitary structure. Being a secular state everybody has right to religion as they want. There is a clear provision of the formation, power, and function of legislative, executive and judiciary. They jointly work for the development of a nation. So our country is the democratic country.

According to the present constitution, a president is the head of the nation. He runs the nation by cooperating with different constitutional organ. Some of them are as follow:

  • Election Commission
  • National Human Right Commission
  • Auditor General etc

Features of Ideal Constitution

The following are the features of an ideal constitution:

  • A constitution should be clear and free from uncertainty and dispute.
  • A constitution should be changeable.
  • A constitution should guarantee the fundamental rights of the citizens.
  • Its aim is to promote the public welfare.
  • It implements the law and rule in the country.
  • It controls Executive, Legislative and Judiciary body of a country.

Types of Constitution

There are two types of constitution in Nepal, they are as follow:

  • Written Constitution
    A written constitution is a formal document that represents the view of the constitutional agreement, the law that rules the political system and the rights of citizens and governments in a classified form.

  • Unwritten Constitution
    The unwritten constitution refers to the concept and manner that are allowed as a require part of Nepalese government, although that they are not actually in the constitution.



  • Constitution is the fundamental part of the country which makes and implemented the law in the nation.
  • Constitution of a country is determined by the political parties and government, who govern the nation.
