Fundamental Aspects of Child Rights
The starting of the teenage age of a child is considered to be the age for maturity period of children. Among this too, the age of sixteen is regarded as the time period when a person is referred to be conscious about own roles and responsibilities. Physical and mental development seemingly occurred at the age of sixteen and people below sixteen are termed to be still a kid. A person attains physical and mental maturity at the age of sixteen.
The person above sixteen is taken to be matured enough than that of the person below sixteen who are meant to be children.
Children are strongly believed to be the active participants for development. The development either of family, society or nation depends on upon the children. Children are growing youth of the nation who will work for the development of nation at their time. But for this, each and every matured people should think about assisting them in their work. Children cannot work for all on own, they cannot develop their personality alone. In order to maintain the level of their living and to live in a peaceful way, they are to provide proper services. Knowingly, in the society, we can find different children who are an orphan, disable, poor, sick and so on. Such children cannot stand the problems in their life themselves they are to be assisted and are to be helped strongly. Food, shelter, proper health facilities, sports, entertainment, love and care are some of the basic needs which children seeks and such basic things that children needs for their development and personal growth falls under child rights, Hence, its responsibility of nation, every individual and society to let children use their rights in a sufficient manner.
Going in a flashback enable us to sketch the situation of children in past. While remembering the past the clear picture about the children in past can be drawn which knowingly was worst. In past people were not conscious about child right and rights of children was hindered but now the time has changed. Different attempts are made in order to protect the child rights and child rights are being promoted in order to make every people aware about it.
With combine collaboration with that of the United States , Declaration of the Rights of the child was made in 1959 which states every child have the right to get love and care, for understanding, for food, shelter, medical care, education, recreation and develop the personality in a proper way. And children who are an orphan or either disabled are meant to get special care regarding promotion and protection.
In 1979 the convention was passed by the United States which states what government must do if it accepts it. Also. Convention on the rights of the child was published in 1990 which extended pattern of child’s rights and a committee was formed to check whether the government is working to keep their agreement or not. The different mean of rights was made prioritizing the children but despite the right and convention millions of children lack the basic rights of food, shelter, education and freedom due to abuse.
Despite the law and convention made for the children numbers of children seemingly can be found to be suffering from plenty of problems. War and conflict also as one of the major problem for chil’d suffering. In first and second world war many of the children lost their parents and became an orphan and were compelled to live life in lack, lack of proper food and shelter. Likewise, millions of childrens got affected by the consequences of war. War that results hunger, poverty, environmental pollution and in such children were forced to live very miserable life. On the other hand, child is being victimized by the social evils and superstitions too and due to which they have kept apart from their legan and basic rights. Therefore, in order to develop status of children, everyone should be conscious about giving equal oppourtunity to all the children for their personal development and its responsibility of all to participate in improvemental work of emancipating children from such miserable situation.
According to the UN Declaration of Rights of the Child, child rights have been divided into the mentioned for groups and they are :-
The inborn right of every child is right to live. To remain safe during pre-natal period, to get safe birth and to receive proper care are inherent rights of the child. Proper feed, proper shelter, and clothing is the must for the children according to the child right hence, proper management for to provide all these basic needs are needed to be made. Proper living refers sufficient use of rights and for living sound health too is needed regarding this getting vaccinated to fight against diseases also is the must.
For personal development, proper education, medical care, participation, love and care, sports, entertainment is the must. All the aspects of needs in order to assist in development should be provided to children. Every child should be provided opportunities for their physical and mental development. Proper guidance and co-operation enhance one to perform better hence, good co-operation from family and society helps a child in the development of their physical and mental aspects.
Protection refers to the state of being “safe” hence its right of every child to be safe. Employing children in factories, mines, and risky activities are against rights of child hence, no child are meant to be compelled in work in danger. Each and every child is meant to be free from discrimination, exploitation, and torture. No child is meant to be forced to engage in criminal acts they are to be protected drug-addiction, trafficking, and abuse. No death penalty and lifelong imprisonment and any other severe punishment are meant to be imposed on the child. A child is supposed to keep far from every kind of life threatening acts, wars, conflicts and other dangers.
It is the right of every child to take part in developmental activities. The right of children to get opportunities to engage in productive work for the development of own personality and personal growth is meant to be right to participation. Children are meant to provide freedom too, freedom to be expressive, freedom to express themselves. Without any discrimination, they are to be allowed to participate in different religious, cultural functions. Children are to be given chance to establish an organization and promote aspects of their welfare.
UN Declaration of the Rights of the Child made on 1989 is termed as international law for all those countries who have agreed it hence, its responsibility of those countries to implement such agreement in practice for promotion and welfare of child rights and to improve the status of children.
Child Rights in Eastern Philosophy
Eastern philosophy emphasizes on religious beliefs regarding chilgren whre children are taken as an incarnation of God hence they are to be praised and are to be treated well. Vies of educating child are providing them the proper education are mentioned in the book for children, Panchatantra and Hitopadesh. Chankya the great personality had mentioned the fact that educating a child in a proper manner praise to entend the prestige of family and their generation. In addition, presenting toys to the childrens, comforting them and feeding them is the way for salvation as mentioned in Chanakyaniti. A person who loves and cares the child and fulfill the needs of a child directly go to heaven and resides under safe hands of God.
Child Rights and Nepalese Laws
Nepal agreed to the UN Declaration of Rights of the Childs in 1990. Different legal conventions were made under this are were implemented as law. The constitution of Nepal is protecting the existence of child and has been promoting their welfare and also been prohibiting the employment for the child in risky jobs.
According to Integrated Children’s Act 2048BS Child Right has been protected in Nepal in the following ways :-
In Nepal NCO, Nepal Children Organization has been contributing in protecting child rights along with ministry for Women, Children and Social Welfare which has been working for improving the status of children through promoting the essence of rights of the child. Different orphanage and special care center for preserving rights of children and to care children are being run in different places of the nation. On the other hand retardation and rehabilitation centers are functioning in order to address the welfare of the children. Also, Central Child-welfare Committee and District Child Welfare committee established in 2052BS too are working for child’s welfare. Save The Children, Educate Children like NGOs and different international organizations are also working for uplifting rights of the children. There are various other agencies too that are working for children in co-proper networking with that of the different organizations.
Rights for the children are termed as the child’s rights. The main aim of child right is to promote a living standard of each child. Since, children themselves cannot live on their own, cannot tackle the problem of single effort child right assist them to utilize their right without any restriction. Children are not aware of different things, therefore, its duty of elders one to protect the child rights. When family, society, and nation comes at the same point then the effort can be contributed to safeguarding the rights of the children.
